Updated version – 7 October 2026
These Terms and Conditions govern the use of the Voiajor.net platform and participation in the online auctions organised through it. They must be read together with the information displayed for each auction and lot, the Payment Note, the Privacy Policy and, where applicable, the seller's specific documents.
The Voiajor.net platform is operated by VOIAJORULNET IMPEX S.R.L., tax ID (CUI) 44997978, Trade Register number J2021001756020, with registered office in Ineu, Str. Ștefan cel Mare no. 24, Arad County, Romania, e-mail info@voiajor.net, telephone +40 725 928 653.
For pigeons belonging to third parties, VOIAJOR.NET provides the auction infrastructure and the intermediation service for the seller. The seller indicated for the lot remains the owner and the legal seller of the pigeon; VOIAJOR.NET does not acquire ownership of the pigeon by organising the auction.
The seller mandates VOIAJOR.NET to administer the bidding and award mechanism and to collect, in the seller's name and on the seller's behalf, the price of the lots that have been awarded and actually paid. In this relationship, VOIAJOR.NET acts for the seller, not as the buyer's agent.
The user must provide correct and up-to-date data and is responsible for keeping their login credentials confidential. Bids entered through the user's account are attributed to the user, except in cases of proven unauthorised access. Any suspicion that the account has been compromised must be reported to VOIAJOR.NET without delay.
For each third-party seller, VOIAJOR.NET indicates, on the basis of the seller's declaration, whether or not the seller acts as a professional. If the seller declares that they are not a professional, the buyer is informed, before the bid/transaction becomes binding, that the consumer-protection rights applicable to contracts between professionals and consumers do not apply to that contract in the same manner.
If the seller is a professional and the buyer is a consumer, the mandatory consumer-protection rules apply to the extent they are relevant. Nothing in these terms limits the mandatory rights granted by law.
The seller determines the pigeons entered in the auction and the starting price of each pigeon. Before the auction starts, the seller may also set a reserve price, being the minimum price at which the seller agrees to sell. The reserve price may differ from the starting price and does not have to be displayed publicly.
As long as the highest bid is below the reserve price, the platform highlights it in red, together with the note “Below reserve price”. If the reserve price has not been reached when the auction closes, the lot is not awarded and is not sold. Its operational status is “Unsold – reserve price not met”. No Payment Note is issued for such a lot, no price is collected, and the lot is not included in the financial settlement or in the calculation of the commission.
The closing date and time, the bidding increment and any applicable automatic extension rule are those displayed on the auction page. A validly registered bid constitutes the user's commitment to buy the lot if it is awarded under the published conditions.
A lot is awarded when, at the close of the auction, there is a valid winning bid and, if the lot has a reserve price, that price has been reached or exceeded.
After the award, the buyer is issued a PAYMENT NOTE (NOTĂ DE PLATĂ), in which the seller, VOIAJOR.NET as intermediary, and the buyer are separately identified.
VOIAJORULNET IMPEX S.R.L. acts as the seller's intermediary and is mandated to collect the awarded price in the seller's name and on the seller's behalf.
The Payment Note is a payment note relating to the award and contains the payment instructions. It is not the invoice issued by VOIAJORULNET IMPEX S.R.L. for the sale of the pigeon.
The buyer must pay the amount shown in the Payment Note within 5 (five) days of the award/close of the auction, according to the due date stated in the document. Payment to the account indicated by VOIAJOR.NET discharges the payment obligation towards the seller up to the amount actually received and identified.
A lot that has been awarded but whose price has not actually been collected is shown separately as awarded – unpaid and must not be confused with a lot that is “Unsold – reserve price not met”. Unpaid lots are not included in the seller's financial settlement and do not generate a commission for VOIAJOR.NET.
Before each auction, VOIAJOR.NET sets the commercial EUR/RON exchange rate used to display/convert prices in that auction. The rate is a commercial rate of the auction and is not presented as the National Bank of Romania (BNR) rate unless expressly stated.
Transport is not included. VOIAJOR.NET does not provide, organise, intermediate or collect payment for transport.
The dispatch/handover of the pigeon and the relationship with the carrier are outside the VOIAJOR.NET service. The transport cost is paid directly in accordance with the agreement between the parties involved and is not included in the Payment Note, the commission invoice or the VOIAJOR.NET settlement. The parties directly involved in the transport are responsible for the applicable legal obligations.
For lots for which the seller has accepted this mechanism in the contract concluded with VOIAJOR.NET, the seller grants the buyer a contractual commitment of 14 (fourteen) days, counted from the date the buyer actually receives the pigeon.
If, during this period, the pigeon falls ill or dies, the buyer must inform VOIAJOR.NET and/or the seller without delay and provide the information and evidence reasonably available regarding the identity of the pigeon, the date of receipt and the situation complained of. Where the nature of the case justifies it, reasonable veterinary documents or findings may be requested.
The situation is resolved in one of the following ways, agreed jointly by the seller and the buyer:
Transport is not part of the amount collected by VOIAJOR.NET and, in the absence of a separate agreement between the seller and the buyer or of an applicable legal obligation, it is not included in the refund made through VOIAJOR.NET.
This commitment is assumed by the seller of the pigeon. VOIAJOR.NET may facilitate communication and, if the refund concerns an amount still within its financial flow or if the parties agree and the amounts can be traced, may facilitate the refund operation, without thereby becoming the seller of the pigeon.
This contractual mechanism neither limits nor replaces the mandatory rights provided by law. Where the seller is a professional and the buyer is a consumer, all relevant statutory rights additionally apply, and any commercial guarantee offered to the consumer produces the effects provided by law.
The seller is responsible for the right to sell the pigeon and for the accuracy of the information, ring numbers, pedigrees, photographs, results and other data provided. VOIAJOR.NET may request supporting documents and may correct, suspend or remove a lot if there are reasonable grounds concerning the authenticity, provenance, legality or accuracy of the information.
The VOIAJOR.NET commission is agreed separately with the seller for each auction. The commission is due only for lots whose price has actually been collected. No commission is calculated for unsold lots, lots whose reserve price was not met, or lots that were awarded but not paid.
After the amounts actually collected have been identified, VOIAJOR.NET prepares the auction settlement statement, withholds/offsets the agreed and invoiced commission, and transfers the resulting net amount to the seller, in accordance with the contract concluded with the seller.
VOIAJOR.NET processes the data necessary for administering accounts and auctions, performing contracts, financial and accounting records, preventing abuse and fulfilling legal obligations. Details on the processing of data are set out in the Privacy Policy.
Sellers must provide the information and documents lawfully requested for identification, record-keeping and, where applicable, DAC7 reporting. DAC7 reporting does not, in itself, establish the existence or the amount of a tax liability of the seller.
Manipulation of auctions, fraudulent bids, abusive use of accounts, false information and unauthorised access to systems are prohibited. VOIAJOR.NET may suspend accounts or operations affected by fraud, an obvious technical error or a breach of the rules, while keeping the necessary records and complying with applicable law.
In the event of a technical failure that may significantly affect the outcome of an auction, VOIAJOR.NET may take the reasonable measures necessary to restore a correct and documentable conduct of the auction.
Complaints about the operation of the platform are sent to info@voiajor.net. Complaints about the condition, identity or characteristics of the pigeon are resolved according to the roles of the seller and the buyer and the rules applicable to the lot. Refunds financially intermediated by VOIAJOR.NET are made only if there is a basis for them, the necessary agreement/obligation, and traceability of the amounts.
Romanian law applies, without affecting the mandatory rules applicable to consumers and to cross-border situations. The parties will try to resolve disputes amicably. The jurisdiction of authorities and courts is determined in accordance with the law; these terms do not derogate from the mandatory jurisdiction rules applicable to consumers.
VOIAJOR.NET may update these terms to reflect changes in the services, in the platform mechanism or in legislation. The updated version is published on the website and shows the date of the last update. Amendments do not retroactively affect rights and obligations that have already arisen, except where permitted or required by law.
